Welcome to ProductImageUpscale AI. These Terms of Service ("Terms") govern your access to and use of my application, website, and related services ("Service").

Individual Operation: Please read carefully before using the Service. I currently operate this Service as a solo developer and individual based in Nepal, not as a registered corporate entity. By accessing or using the Service, you agree to be bound by these Terms and acknowledge this operational structure.

You agree to use the Service strictly for lawful purposes. You must not:

• Upload explicit, illegal, non-consensual sharing, or harmful imagery.
• Upload images for which you do not own the rights or hold legal permission to process.
• Attempt to reverse-engineer, decompile, or bypass the Service's security restraints.
• Use the Service in any way that violates applicable local, national, or international laws.

I reserve the right to review uploads and suspend or terminate accounts that breach this policy immediately and without refund.

Your Content: You retain full ownership and rights over the original images you upload to the Service, as well as the processed, upscaled outputs generated for you. I claim no ownership over your inputs or outputs.

Service Code and Assets: The underlying source code, design elements, algorithms, algorithms interfaces, and branding of the Service are my intellectual property. You may not copy, reproduce, or resell access to the Service.

Our Image processing inherently utilizes Artificial Intelligence (AI) to hallucinate, interpolate, and create missing pixel data to increase the resolution and visual quality of images.

• No Guarantee of Accuracy: I cannot mathematically guarantee that AI-inferred textures exactly replicate real-world physical fabrics, weaves, or textures. The Service attempts to provide the most visually pleasing outcome based on trained algorithms.
• Review Requirement: You are responsible for reviewing and approving all processed images before utilizing them in strict compliance use-cases such as commercial catalogs, manufacturing references, or medical contexts.

Certain features of the Service are billed on a subscription or pay-per-usage basis.

• Billing: You will be billed in advance on a recurring and periodic basis depending on your subscription selection.
• Refunds: Due to the high computational costs associated with AI processing, I generally do not issue refunds for processed credits or active subscription periods. I may offer refunds on a case-by-case basis at my sole discretion if there is a demonstrated technical failure of the Service.

I reserve the right to suspend or terminate your account and bar access to the Service immediately, without prior notice or liability, under my sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms or the Acceptable Use Policy.

You may also terminate your account at any time through the settings dashboard. Terminated accounts will forfeit any remaining processing balance without refund.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I (THE SOLO DEVELOPER) BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.

Under no circumstances will my total liability exceed the amount you have paid to me in the last three (3) months for the Service.

You agree to defend, indemnify and hold harmless ProductImageUpscale AI and myself from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
